Severability of Insurance

What Does Severability of Insurance Mean?

Severability of insurance means coverage applies separately to each party or entity. Actions or circumstances of one insured won’t necessarily affect protection for others under the same policy.

The purpose is to protect innocent insured parties from the actions, misrepresentations, or breaches of duty by another insured party. It prevents the entire policy from being invalidated or coverage being denied solely based on the actions of one party.

In practical terms, if one insured party breaches the terms, provides false information, or commits fraud, the insurance company may take action against that specific party. However, the coverage for others who are not involved in the misconduct remains intact.

The severability of insurance provision helps to maintain fairness and protect the interests of innocent parties who have complied with the terms of the policy. It allows for the possibility of an insurance claim or coverage being honored for those who have acted responsibly and in good faith, even if another party included by the same policy has acted inappropriately.

Additionally, the cross-liability clause insurance and separation of insureds are related concepts that can be included in a policy. The cross-liability clause allows for coverage to apply separately to each insured party, even if they are jointly liable for a claim. The separation of insureds provisions ensure that each insured party is treated as if they have a different policy, avoiding conflicts of interest or limitations in coverage between parties.

How does Severability of Insurance Work at PSIC?

At PSIC, if two insured individuals under the same policy are sued in a liability claim, their actions don’t affect each other’s demand. Each is treated independently, as if they had separate policies. However, the liability limit is shared, determining the maximum coverage for both.

Severability is an important concept in Liability insurance as it ensures that each individual can receive the appropriate protection based on their own liability and circumstances. This provides peace of mind and security for both the insured individuals and the company.
