What Does Res Ipsa Loquitur Mean?

Res ipsa loquitur is a latin phrase that translates to “the thing speaks for itself.” In the legal world, including insurance law, it’s a legal doctrine that allows a plaintiff to establish negligence without direct proof.

 

In the context of insurance, res ipsa loquitur can be applied to situations where an accident or injury occurs under circumstances that suggest negligence, even without specific evidence of wrongdoing. Imagine a scenario where a homeowner’s roof collapses during a minor rainstorm. There’s no evidence of a severe storm, and the roof was recently inspected and deemed structurally sound. In this case, its sudden collapse, absent any other explanation, could suggest negligence on the part of the contractor who installed or maintained it.

 

However, the application of res ipsa loquitur can be complex and varies by jurisdiction. It typically requires that:

  • The event is of a kind that ordinarily does not occur in the absence of negligence.
  • The event is caused by an agency or instrumentality within the exclusive control of the defendant.
  • The event must not be due to any voluntary action or contribution on the part of the plaintiff.

 

If these conditions are met, the burden of proof shifts to the defendant to demonstrate that they were not negligent. This can be a significant advantage for plaintiffs in insurance claims, as it can simplify the legal process and increase the likelihood of a successful claim.

  • Personal information as defined in Customer Records law: Name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, education, professional license number employment history, bank account number, other financial information, medical information, and/or health insurance information.
  • Characteristics of protected classifications under California or federal law such as race, age, sex, familial status, and disability.
  • Audio, electronic, visual, or similar information such as photographs and call recordings
  • Background check information such as your criminal and credit history

  2. How Long Your Personal Information Will Be Kept. We will keep your personal information for as long as is necessary while you are employed by us. Thereafter, we will keep your personal information:
  • To respond to any questions, complaints or claims made by you or on your behalf or;
  • To keep records required by law. In California, this is currently and generally a minimum of four (4) years.

We will not retain your personal information for longer than necessary for the purposes set out in this notice. Different retention periods apply for different types of personal information.

When it is no longer necessary to retain your personal information, we will delete or anonymize it.
